Agreement to Terms

By accessing or using the services of American Notary Services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our services.

Services Provided

American Notary Services provides mobile notary public services throughout Utah. Our services include, but are not limited to:

  • Notarization of legal documents
  • Mobile notary services at client-specified locations
  • Document witnessing and authentication
  • Real estate document notarization
  • Business document notarization

Remote Online Notarization (RON) and loan signing services will be available in the future.

Client Responsibilities

When using our services, you agree to:

  • Provide valid, current government-issued photo identification
  • Present unsigned documents for notarization (unless otherwise specified)
  • Understand the contents of documents being notarized
  • Sign documents willingly and without coercion
  • Be physically and mentally competent to sign
  • Provide accurate information for scheduling and service delivery
  • Pay agreed-upon fees in a timely manner

Fees and Payment

Fees for notary services are determined by:

  • Utah state-mandated notary fees for notarization acts
  • Mobile service fees based on location and time requirements
  • Additional charges for after-hours or same-day emergency services

All fees will be communicated clearly before services are rendered. Payment is due at the time of service unless other arrangements are made in advance.

Cancellations and Rescheduling

If you need to cancel or reschedule an appointment, please notify us as soon as possible. Cancellations made less than 2 hours before the scheduled appointment may be subject to a cancellation fee to cover travel and scheduling costs.

Refusal of Service

We reserve the right to refuse notary services if:

  • The signer lacks proper identification
  • The signer appears to be under duress or coercion
  • The signer appears to lack mental capacity
  • The document is incomplete or appears fraudulent
  • The notarization would violate state law or notary regulations
  • The notary has a personal interest in the transaction

Liability and Disclaimers

American Notary Services provides notarization services in accordance with Utah state law. We:

  • Do not provide legal advice
  • Do not guarantee the legal effect of any document
  • Are not responsible for the content of documents we notarize
  • Cannot advise on which documents you need or how to complete them

Clients should consult with an attorney for legal advice regarding their documents. Our liability is limited to the maximum extent permitted by Utah law and our notary bond coverage.

Confidentiality

We maintain the confidentiality of your personal information and documents in accordance with notary laws and our Privacy Policy. However, we may be required to disclose information in response to legal process or as required by law.

Record Keeping

As required by Utah law, we maintain a notary journal recording all notarial acts. These records are kept secure and retained for the period required by state regulations.

Website Use

Our website is provided for informational purposes. You agree not to:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Transmit viruses or malicious code
  • Interfere with the proper functioning of the website

Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of American Notary Services and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

Governing Law

These Terms and Conditions are governed by the laws of the State of Utah. Any disputes arising from these terms or our services shall be resolved in the appropriate courts of Utah.
